On December 26, 2008, the Minister of Nature Protection of RA signed the Decree N 474-N on Establishing a Procedure for Submittal of Project Design Document under the Kyoto Protocols' Clean Development Mechanism.
The document was developed in accordance with the provisions of the clause 3(a) of the Decision #974-N of July 13 2006 of the Government of the Republic of Armenia On Implementation of Projects within the framework of the Clean Development Mechanism of the Kyoto Protocol under the United Nations Framework Convention on Climate Change.
The procedure sets conditions for submission of CDM Project Design Documents in two steps, including: (i) the non-obligatory stage of submission, assessment and endorsement of a project idea note and (ii) the mandatory stage of submission, assessment and approval of a project design document.
The provisions of the Decree N 474-N is mandatory for all CDM project design documents submitted to the Ministry of Nature Protection of RA (Designated National Authority for the CDM in Armenia) for endorsement and approval.

PROCEDURE
FOR SUBMITTAL OF PROJECT DESIGN DOCUMENTS UNDER THE CLEAN DEVELOPMENT MECHANISM
I. GENERAL PROVISIONS
1. The present Procedure shall establish and regulate the process of submittal of project design documents for the projects implemented under the Clean Development Mechanism as referred in Article 12 of the Kyoto Protocol of the Framework Convention on Climate Change.
2. Terms used in the present Procedure are as follows:

1) Clean Development Mechanism: A mechanism established by Article 12 of the Kyoto Protocol of the Framework Convention on Climate Change, which allows the Convention Member States, referred to in Annex I, to implement greenhouse gas emission reduction projects in the (developed) countries not included in the Annex I and to use the Certified Emission Reductions for meeting their quantitative obligations under the Kyoto Protocol. |

|
2) Certified Emission Reduction: a unit equal to one metric ton of carbon dioxide's equivalent, which is issued in line with Article 12 of the Kyoto Protocol. The certified emission reductions are used to measure the certified greenhouses gas reductions achieved through implementation of the Clean Development Mechanism projects. |
|
|
3) International procedures and requirements: Criteria and requirements referred to in the Kyoto Protocol's Clean Development Mechanism and other relevant documents of the Framework Convention on Climate Change; |
|
4) Designated National Authority: A national body authorized by the Kyoto Protocol's Member Country to function as a National Clean Development Mechanism Authority coordinating the implementation of the Clean Development Mechanism and approving the Clean Development Mechanism project design documents in the country. |
|
|
|
5) Project Idea Note: A document containing a brief description of the proposed Clean Development Mechanism Project which is submitted to the Designated National Authority to get its conclusion. |
|
|
6) Project Design Document: A document prepared in accordance with the provisions and requirements of the Clean Development Mechanism and the present rules. |
|
|
7) Project Participants: A contributing party (a Party to the Kyoto Protocol and a participant in the Clean Development Mechanism), which is referred to in a project document as a project participant; or a private and (or) non-government organization which has been authorized to contribute to a Clean Development Mechanism Project by a contributing Party. |

|
8) Clean Development Mechanism Executive Board: An international body which supervises the Clean Development Mechanism, under the authority and guidance of the Conference of the Parties (COP) of the United Nations Framework Convention on Climate Change / Meeting of Parties (MOP) to the Kyoto Protocol, and is fully accountable to the COP/MOP. Particularly, the Executive Board of the Clean Development Mechanism shall perform the registration of the Clean Development Mechanism Projects and certification of the greenhouse gas emission reductions. |
II. SUBMISSION OF PROJECT DESIGN DECUMENTS FOR CLEAN DEVELOPMENT MECHANISM PROJECTS
3. Clean Development Mechanism project design documents may be submitted and approved in two steps, [including]:
| 1) the non-obligatory stage of submission, assessment and endorsement of a project idea note; | |
| 2) the stage of submission, assessment and approval of a project design document. |
4. Project Participants to a project may draft a Project Idea Note for initial review and endorsement by the Designated National Authority. The Project Idea Note shall be submitted to the Designated National Authority on a voluntary basis and shall not be considered as a prerequisite for approval of a Clean Development Mechanism Project (voluntary stage).
5. The Project Idea Note shall be submitted to the Designated National Authority in the Armenian language in two copies in electronic and hard forms along with a respective Letter of Application. The Letter of Application shall be signed and stamped by all the participants of a Clean Development Mechanism Project.
6. If the Project Idea Note is prepared by the Project Participants in collaboration with any international organization, then the format in which it is submitted can be that used by that international organization.
7. If, by the time of the official submission of the Project Idea Note, participants of the project already know which organizations shall acquire the expected Certified Emission Reductions, they will make a relevant note about it in the Letter of Application mentioned in Clause 5 of the present Procedure. The Project Participants shall notify the Designated National Authority in written of any changes in the parties and/or organizations acquiring the Certified Emission Reductions if such changes take place before the formal submission of a Project Design Document.
8. In order to get approval for a project implemented under the Clean Development Mechanism, participants of a Clean Development Mechanism Project shall draft and submit to the Designated National Authority a project document package (in electronic and hard formats), including the following:

1) A Letter of Application addressed to the Designated National Authority, signed and stamped by all the participants of a Clean Development Mechanism Project; |
|
|
2) A Project Design Document which shall be drafted in the Armenian language following the international procedures and requirements for the Clean Development Mechanism. (The Project Design Document shall be submitted to the Designated National Authority in a format approved by the Executive Board of the Clean Development Mechanism and posted in the official website of the Secretary of the Framework Convention on the Climate Change by the time of the submission of the document. A Project Design Document shall also include information on the contribution of the submitted Clean Development Mechanism Project to the sustainable development objectives of the Republic of Armenia and on the compatibility of the project with the country's sustainable development goals); |
|
|
3) A document (declaration), signed by all the participants of the Clean Development Mechanism Project, nominating and approving the participant (person) in charge of negotiating with the Designated National Authority; |
|
|
4) Records of public discussions (hearings) on a Clear Development Mechanism Project, if, with the agreement of the Designated National Authority, public discussions (hearings) were held by the Project Participants to deliberate on the Clean Development Project; |
|
|
5) A statement setting out the principles of distribution of the resulting Certified Emission Reductions, if, at the time of submittal of a Project Design Document the Project Participants have decided on the distribution of the Certified Emission Reductions. |
